These Terms of Service ("Terms") govern your use of the CashOut mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. What CashOut is — and isn't
CashOut is an informational tool that helps you discover class action settlements and track the ones you're interested in. CashOut is not a law firm, an attorney, a claims administrator, a court, or a government agency. We do not provide legal, financial, or tax advice, and using the App does not create an attorney-client or fiduciary relationship.
2. No guarantee of eligibility or payment
Settlement information is provided for general awareness and may be incomplete, out of date, or inaccurate. We do not determine your eligibility for any settlement and we do not guarantee that you will qualify for or receive any payment. You are solely responsible for reviewing the official settlement materials, confirming your eligibility, and submitting any claim directly through the official administrator. Any payout amounts shown in the App (including estimates) are illustrative only.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the App and to purchase a subscription.
4. Subscriptions, billing, and cancellation
- The App offers auto-renewing subscriptions that unlock premium features.
- Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple or Google account settings after purchase.
- Refunds are handled by Apple or Google according to their policies; we generally cannot issue refunds directly.
5. Acceptable use
You agree not to misuse the App, including by attempting to interfere with its operation, reverse engineer it, access it through unauthorized means, or use it for any unlawful purpose.
6. Intellectual property
The App, including its design, text, and logos, is owned by us or our licensors and is protected by intellectual property laws. Company names and logos referenced in connection with settlements belong to their respective owners and are used for identification only.
7. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that the information it contains is accurate or complete.
8. Limitation of liability
To the maximum extent permitted by law, CashOut and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of money, profits, or settlement awards, arising out of or related to your use of (or inability to use) the App.
9. Indemnification
You agree to indemnify and hold harmless CashOut and its developers from any claims or demands arising out of your use of the App or your violation of these Terms.
10. Third-party links
The App may link to third-party websites, including official settlement claim portals. We are not responsible for those websites or their content, and accessing them is at your own risk.
11. Changes to the App and these Terms
We may modify or discontinue features at any time, and we may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of [Your State], United States, without regard to its conflict-of-laws rules.
